1. Acceptance of Terms and Conditions

1.1 By using the services of Dr Joseph McAndrew, including accessing any associated website or online platform, you are deemed to understand, consent to, and agree to be legally bound by these Terms and Conditions.

 

2. Terminology

2.1 The term “service” refers to the psychiatric services provided by Dr Joseph McAndrew as a sole trader in Ireland.
2.2 The term “website” refers to any online platform or booking system used by Dr McAndrew.
2.3 The term “doctor” or “consultant” refers exclusively to Dr Joseph McAndrew, Consultant Psychiatrist, registered with the Irish Medical Council.
2.4 The term “law” refers to all relevant Irish and European legislation.
2.5 The term “Terms and Conditions” includes this document, the Privacy Policy, and the Disclaimer.

 

3. Professional Responsibility

3.1 Dr McAndrew takes the same professional responsibility for each patient as he would in a face‑to‑face consultation. The online nature of the service does not diminish his professional obligations.
3.2 All practice is conducted in accordance with Irish Medical Council guidelines, the College of Psychiatrists of Ireland, and the Mental Health Commission.

 

4. Information Provided by You

4.1 You agree that all information you provide will be true, complete, and not intentionally withheld.
4.2 Patients may access copies of their assessment and care plan after their consultation.
4.3 Booking links are issued after payment is completed.

5. Scope of sole trader telehealth

5.1 As this is an online psychiatric service, certain conditions may fall outside the scope of safe online management. Referrals may be declined.
5.2 Prescriptions will be sent securely to your nominated pharmacy via Healthmail.

 

6. Prescriptions

6.1 Prescribed medication is for your personal use only.
6.2 Prescriptions are sent electronically to your nominated pharmacy.
6.3 You agree to read all medication information provided by the doctor, the manufacturer, and the pharmacist.
6.4 If you experience side effects, you agree to book a medication review and consult your GP.

 

7. Communication With Your GP/Referrer

7.1 You consent to your GP/referrer being updated on your assessment, diagnosis, and care plan.
7.2 You agree to provide accurate GP contact details.

 

8. Informed Consent

8.1 By requesting an online consultation, you give informed consent for assessment, data collection, collateral information gathering, and treatment where indicated.
8.2 You acknowledge that medications may have side effects and that alternatives may be discussed.

 

9. Consultation Data

9.1 You agree not to share your consultation link with anyone.
9.2 You agree to secure your devices with appropriate cybersecurity measures.
9.3 You must provide a valid email address and phone number.
9.4 You consent to being contacted by email or phone when necessary.

 

10. Cancellations & Refunds

10.1 Appointments may be rescheduled if the doctor becomes unavailable.
10.2 Rescheduling is free if done more than 24 hours in advance.
10.3 Cancellations less than 24 hours before the appointment incur a 50% fee.
10.4 Rebooking more than 24 hours in advance is permitted.
10.5 Once a consultation has taken place, no refunds are issued.
10.6 Missed appointments (“No Shows”) are non‑refundable.
10.7 If the doctor is unable to provide the service, a full refund will be issued.
10.8 Services are not provided to individuals under 18.
10.9 Referrals outside the scope of practice will be declined.
10.10 Refunds are processed via bank transfer and may take 5–10 working days.
10.11 If part of a consultation has taken place, 50% of the fee applies.
10.12 Refunds may take up to 30 days to process.

 

11. Right to Refuse Service

11.1 Dr McAndrew reserves the right to refuse service. If payment has been made, a full refund will be issued.
11.2 Return to the service may require clearing any outstanding balance.

 

12. Electronic Communication Risks

12.1 Electronic communication carries inherent risks, and absolute security cannot be guaranteed.
12.2 All reasonable efforts will be made to secure data in accordance with GDPR and Irish/EU law.

 

13. Disclaimer

13.1 To the fullest extent permitted by Irish law, Dr McAndrew is not liable for:
• emotional distress
• data loss
• financial loss
• business or opportunity loss
• reputational damage
• third‑party losses
• indirect or consequential damages

13.2 Nothing excludes liability for death or personal injury caused by negligence.
13.3 No warranties are made regarding treatment outcomes or reliance on advice.
13.4 No guarantee is made that online services will be uninterrupted or error‑free.
13.5 Liability for third‑party services rests with the provider.

 

14. Changes to Terms

14.1 Terms may be updated at any time.
14.2 You are responsible for reviewing updates.
14.3 Continued use of the service constitutes acceptance of updated terms.
